Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Cuepen (the “Service”), an online IELTS writing practice and feedback tool. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is operated by Cuepen (“we”, “us”, “our”). You can reach us at support@cuepen.tech.

Cuepen is an independent study tool. It is not affiliated with, endorsed by, or associated with the IELTS examination or its owners (the British Council, IDP: IELTS Australia, or Cambridge University Press & Assessment). “IELTS” is a trademark of its respective owners.

2. Eligibility and accounts

You must be able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account.

3. The Service and AI-generated feedback

The Service uses automated and AI-based methods to estimate band scores and provide writing feedback. These results are practice estimates intended to help you improve. They are not official IELTS scores and do not guarantee any particular outcome on a real exam. We do not warrant that feedback or scores are error-free.

4. Plans, payments and billing

The Service offers a free tier with limited weekly usage and paid premium options (including subscription passes and pay-per-day access). Paid plans are one-time purchases for the stated period and do not auto-renew unless explicitly stated at checkout.

Payments are processed by our payment partner, Razorpay. We do not store your full card details. Prices are shown at checkout in your applicable currency and are inclusive of taxes where indicated. Refunds and cancellations are governed by our Refund & Cancellation Policy.

5. Acceptable use

You agree not to misuse the Service, including by: attempting to disrupt or reverse-engineer it; abusing usage limits or automating access; uploading unlawful, infringing, or harmful content; or using the Service to violate any law. We may suspend or terminate accounts that breach these Terms.

6. Your content

You retain ownership of the essays and text you submit (“Your Content”). You grant us a limited license to process Your Content to provide and improve the Service (for example, to generate scores and feedback, including via third-party AI processors). We do not claim ownership of Your Content.

7. Our intellectual property

The Service, including its software, design, prompts, and branding, is owned by us and protected by intellectual-property laws. You may not copy, resell, or create derivative works from the Service except as permitted by these Terms.

8. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required by law. Provisions that by their nature should survive termination will survive.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of India, and the courts located in India will have jurisdiction over any disputes, except where applicable law requires otherwise.
